ProTrade Staffing LLC, doing business as ProTrade ("ProTrade," "we," "us," or "our"), respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information in connection with:

  • Our public website at protradestaffing.com;

  • Our client, worker, applicant, and employee portals and related online services;

  • Job applications, recruiting, employment, assignments, timekeeping, payroll, and workforce management;

  • Contractor job requests, worker matching, account administration, invoicing, and payments;

  • Our communications and relationships with applicants, workers, employees, clients, prospects, vendors, and other business contacts.


Together, these are referred to as the "Services."


This Privacy Policy is intended to describe ProTrade's general privacy practices. Additional notices, authorizations, or disclosures may apply to specific activities, including background checks, employment records, benefit plans, text messaging programs, and state-specific privacy rights. If another notice conflicts with this Privacy Policy for a particular activity, the more specific notice will control for that activity.

Who This Policy Applies To

This Privacy Policy applies to personal information we process about:

  • Visitors to our website and users of our online Services;

  • People who inquire about or apply for work through ProTrade;

  • Current and former ProTrade employees and workers assigned to client jobsites;

  • Representatives of current and prospective contractor clients;

  • Vendors, service providers, business partners, and their representatives;

  • Other people who communicate or interact with ProTrade.


Personal Information We Collect

The information we collect depends on your relationship with ProTrade and how you use the Services.


A. Contact and Account Information

We may collect:

  • name, mailing address, email address, and telephone number;

  • company name, job title, department, and business contact information;

  • account username, password or authentication credentials, and account preferences;

  • communications with ProTrade, including emails, calls, text messages, support requests, and form submissions;

  • information you provide when requesting information, creating an account, or contacting us.


B. Client and Job-Request Information

If you represent a contractor client or prospective client, we may collect:

  • company and project information; jobsite address and work location;

  • requested trade, skill level, certifications, headcount, schedule, start date, project duration, and job duties;

  • foreman, project manager, billing contact, and other authorized-user information;

  • worker selections, assignment requests, feedback, replacement requests, and communications;

  • timesheet, hour-approval, invoice, payment-status, credit, and billing information;

  • signed agreements, authorizations, certificates, and other client documentation.


C. Applicant, Worker, and Employee Information

If you inquire about, apply for, or perform work through ProTrade, we may collect:

  • resume, application, employment history, education, training, licenses, certifications, trade experience, skills, references, and work preferences;

  • availability, desired pay, travel range, transportation information, preferred assignments, and jobsite location;

  • interview notes, skill assessments, qualification information, assignment history, attendance, timekeeping, performance, client feedback, safety information, and disciplinary records;

  • proof of identity, age, employment eligibility, and work authorization;

  • Social Security number, government identification numbers, and tax-withholding information;

  • payroll, direct-deposit, compensation, benefits, deductions, and expense-reimbursement information; emergency contact information;

  • background-screening, motor-vehicle, drug-testing, or other screening information when permitted and appropriate for the role;

  • workplace injury, workers' compensation, leave, accommodation, and other health-related information when permitted by law;

  • voluntary demographic information collected for equal-employment, reporting, or compliance purposes. Where required, ProTrade will provide separate notices and obtain appropriate authorization before procuring a background report or conducting other employment screening. Medical and accommodation information is handled confidentially and separately where required by law.


D. Financial and Transaction Information

We may collect information needed to process payroll, direct deposits, invoices, ACH payments, wire transfers, refunds, and other transactions. Bank account and payment credentials may be collected directly by our payroll or payment-processing providers. In those circumstances, ProTrade may receive transaction confirmations, account descriptors, or tokenized payment information rather than complete financial credentials.


E. Device, Usage, and Cookie Information

When you use our website or portals, we and our service providers may automatically collect:

  • IP address and approximate location derived from the IP address;

  • browser type, device type, operating system, and device identifiers;

  • referring and exit pages; pages viewed, links selected, features used, and actions taken;

  • dates, times, and duration of visits; account and authentication activity;

  • diagnostic, security, error, and performance information. We may collect this information through cookies, pixels, web beacons, software development kits, server logs, and similar technologies.


F. Information About Other People

You may provide information about another person, such as a reference, emergency contact, foreman, coworker, or authorized account user. Please provide this information only when you are authorized to do so.


Collection of Information

We may collect personal information:

  • directly from you;

  • from your employer, company, authorized representative, or emergency contact;

  • from recruiting platforms, job boards, professional networks, referrals, and publicly available sources;

  • from references and former employers; from contractor clients, foremen, project managers, and jobsites;

  • from background-screening, payroll, benefits, insurance, timekeeping, payment, and other service providers;

  • from government agencies and legally authorized sources; and automatically when you use our Services.


How We Use Collected Information

We may use personal information to:


  1. Provide Staffing and Workforce Services

respond to staffing requests; recruit, evaluate, qualify, hire, onboard, and assign workers; match available workers to client jobs based on trade, skills, experience, location, schedule, availability, and job requirements; present appropriate worker profiles to contractor clients; manage assignments, schedules, attendance, timekeeping, performance, replacements, and jobsite communications; and communicate with applicants, workers, employees, clients, and vendors.


B. Administer Employment and Business Operations

process payroll, taxes, direct deposits, benefits, reimbursements, and employment records; administer leave, accommodations, workplace safety, incident reporting, workers' compensation, and insurance matters; maintain personnel, client, vendor, and operational records; manage client accounts, contracts, credit review, job requests, invoicing, collections, ACH or wire payments, and financial reporting; and provide customer service and technical support.


C. Operate and Improve the Services

create, authenticate, secure, and administer accounts; personalize and improve website and portal functionality; understand how people use our Services; troubleshoot errors and maintain system performance; develop new features, workflows, and services; and create aggregated or de-identified analytics, provided we do not attempt to reidentify de-identified information except as permitted by law.


D. Communicate and Market

respond to questions and requests; send account, application, assignment, payroll, invoice, payment, security, and service communications; notify workers about relevant opportunities and assignment updates; send newsletters, company updates, or promotional communications where permitted by law; and manage communication preferences and opt-out requests.


E. Protect ProTrade and Comply With Law

verify identity, authorization, and eligibility; prevent, identify, and investigate fraud, misuse, security incidents, unlawful conduct, and violations of our agreements or policies; protect the rights, property, health, and safety of ProTrade, our workers, our clients, jobsites, and others; establish, exercise, or defend legal claims; comply with employment, tax, immigration, payroll, benefits, safety, insurance, licensing, recordkeeping, court, regulatory, and other legal obligations; and respond to lawful requests from courts, regulators, law enforcement, and government agencies. We may also use personal information for another purpose disclosed to you at or before collection, or with your consent.


Cookies and Similar Technologies

We use cookies and similar technologies that may be necessary to: keep the website and portals functioning; authenticate users and maintain sessions; remember preferences; protect accounts and detect misuse; measure website traffic and performance; and understand and improve user interactions. Depending on our website configuration, analytics or advertising providers may also place cookies or similar technologies. You can control cookies through available consent tools and your browser settings. Disabling certain cookies may limit some features of the Services. Where required by applicable law, we will request consent before using nonessential cookies. Where required, we also recognize valid browser-based opt-out preference signals, such as Global Privacy Control, for sales of personal data or targeted advertising.

We may disclose personal information to the following categories of recipients:


  1. Contractor Clients and Jobsites

We may provide contractor clients and authorized jobsite representatives with information reasonably necessary to evaluate, select, onboard, schedule, supervise, and manage workers. This may include a worker's name, contact details when appropriate, trade, skills, experience, certifications, availability, location, profile information, assignment history, and job-related performance information. We do not provide clients with a worker's Social Security number, personal banking credentials, tax forms, or unrelated medical information except when legally required or specifically authorized.


B. Service Providers

We may disclose information to companies that provide services on our behalf, including: cloud hosting, database, cybersecurity, authentication, software, and technical-support providers; applicant tracking, recruiting, onboarding, payroll, timekeeping, benefits, and human-resources providers; payment processors, banks, accounting providers, credit-review providers, and financial institutions; background-screening, drug-testing, credential-verification, and occupational-health providers; workers' compensation carriers, insurance companies, brokers, claims administrators, and safety providers; electronic-signature, document-management, communication, analytics, and marketing providers; and legal, accounting, auditing, consulting, and other professional advisers. These providers are permitted to process personal information only as necessary to provide services to ProTrade, comply with law, or as otherwise authorized by an applicable agreement.


C. Government, Legal, and Safety Recipients

We may disclose personal information when required or permitted by law, including to tax authorities, labor and employment agencies, immigration authorities, workers' compensation agencies, insurance regulators, courts, law enforcement, and other government entities. We may also disclose information when reasonably necessary to protect rights, prevent harm, investigate misconduct, or enforce our agreements.


D. Business Transactions

We may disclose or transfer personal information in connection with an actual or proposed merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction, subject to appropriate confidentiality protections where required.


E. At Your Direction

We may disclose information when you direct us to do so, authorize the disclosure, or intentionally use the Services to interact with another person or organization.


Sale of Personal Information and Targeted Advertising

ProTrade does not sell personal information for monetary consideration. We do not share applicant, worker, employee, client-account, payroll, banking, or SMS opt-in information with third parties for their own marketing purposes.


Text Messaging

By providing a telephone number to ProTrade you are consenting to be contacted by SMS text message. Message & data rates may apply. You can reply STOP to opt-out of further messaging at any time. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.


Email and Other Communication Choices

You may unsubscribe from promotional emails by using the unsubscribe link in the message or contacting us. Even if you opt out of promotional communications, we may continue to send non-promotional messages concerning your application, assignment, employment, account, invoices, payments, security, contracts, or other ongoing relationship with ProTrade.


Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to: provide the Services and maintain your account or relationship with ProTrade; administer recruiting, employment, assignments, payroll, taxes, benefits, timekeeping, safety, and workers' compensation; complete transactions and maintain business and financial records; comply with applicable statutes of limitation, recordkeeping rules, legal holds, and regulatory requirements; resolve disputes, collect amounts owed, and enforce agreements; and prevent fraud and protect the security of the Services. Retention periods vary based on the type of information, the context in which it was collected, operational requirements, and applicable law. When information is no longer required, we may delete, destroy, or de-identify it in accordance with our retention practices.


Data Security

ProTrade uses administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, loss, or destruction. These safeguards are selected based on the sensitivity of the information and may include access controls, authentication, encryption, system monitoring, vendor controls, backups, employee training, and incident-response procedures. No system or transmission method can be guaranteed to be completely secure. You are responsible for maintaining the confidentiality of your account credentials and notifying ProTrade if you believe your account or information has been compromised.


Your Privacy Rights and Choices

Depending on your state of residence, your relationship with ProTrade, and applicable legal thresholds or exemptions, you may have the right to: confirm whether we process your personal information; access personal information we maintain about you; correct inaccurate personal information; request deletion of personal information; obtain a portable copy of certain personal information; opt out of the sale of personal information, targeted advertising, or certain profiling; withdraw consent where processing is based on consent; appeal our denial of a privacy request; and receive equal service and treatment without unlawful discrimination for exercising a privacy right. These rights are subject to legal limitations and exceptions. Certain state consumer privacy laws do not apply to information processed in an employment or business-to-business context. Employment, payroll, tax, safety, insurance, and client-service records may also need to be retained or processed to comply with law or fulfill our obligations.


Submitting a Request

To submit a privacy request, email team@protradestaffing.com with the subject line "Privacy Request" or contact us using the information in Section 18. Please describe your request and your relationship with ProTrade. We may need to verify your identity and authority before fulfilling the request. We will use information provided for verification only to process and document the request. If an authorized agent submits a request, we may require evidence of the agent's authority and may need to verify your identity directly. If we deny a request, you may appeal by replying to our decision or emailing us with the subject line "Privacy Appeal." We will respond within the period required by applicable law.


Third-Party Sites and Services

The Services may link to websites, applications, or services operated by other companies. Their privacy practices are governed by their own notices, not this Privacy Policy. ProTrade is not responsible for the privacy or security practices of unaffiliated third parties.


United States Processing

ProTrade operates in the United States. Personal information may be processed and stored in the United States and in other locations where our service providers operate, subject to applicable law and contractual protections. If you access the Services from outside the United States, your information may be transferred to jurisdictions with different data-protection laws than your home jurisdiction.


Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our Services, technology, vendors, legal requirements, or privacy practices. When we make changes, we will update the "Last Updated" date above. If required by law, we will provide additional notice or obtain consent for material changes.
